PROJECT KAIZEN / LEGAL

Terms of Service.

The agreement governing Project Kaizen personalised online coaching.

Last updated 24 October 2026

1. Parties and agreement

These Terms of Service govern paid online coaching supplied by EASYTRADR – FZCO, trading as Project Kaizen ('Project Kaizen', 'we', 'us'), registered at 52906 - 001, IFZA Business Park, Dubai Digital Park, A1 - 3641379065, Dubai, United Arab Emirates, to the individual purchasing coaching ('you', 'Client'). Contact: jensen@joinprojectkaizen.com. The checkout order confirmation, selected package and these Terms together form the coaching agreement. If the order confirmation conflicts with these Terms on price, package or agreed start date, the specific order confirmation controls. You must be at least 18 years old and provide accurate identity and contact information.

2. Services and scope

Project Kaizen provides personalised remote coaching focused on physique, appearance and presence. Depending on your needs, this may include training programming, general nutrition education and guidance, habit and lifestyle coaching, appearance/presentation recommendations, progress monitoring, weekly check-ins, periodic reviews and digital coaching materials. Services are provided remotely, primarily through Kahunas, with WhatsApp used for welcome and important communications. They do not include in-person supervision, medical diagnosis or treatment, prescribing medication, psychotherapy, regulated dietetic care or emergency assistance. We may recommend that you consult a suitably qualified professional where appropriate.

3. Package selection, price and duration

Packages currently offered are 3 months (£750), 6 months (£1,400) and 12 months (£2,400), unless a different price is expressly shown and accepted at checkout. Your checkout confirmation identifies the purchased package, total payable amount, currency and any applicable taxes or fees. Each package is for a fixed term and does not automatically renew. The coaching term begins on the mutually agreed coaching start date after onboarding and initial setup, not merely on payment. We will confirm that date in writing. Delays caused by incomplete client onboarding may require a revised start date agreed in writing. Any package changes require written agreement.

4. Payment and third-party financing

The full package price is payable upfront through the offered checkout method. Project Kaizen does not offer or administer direct instalment payment plans. Where an independent third-party financing or buy-now-pay-later provider is offered, its separate eligibility rules, financing agreement, repayment schedule, charges and credit decisions apply between you and that provider. Financing does not change the total coaching package purchased or these service terms. Refunds, where owed, will be processed in accordance with applicable law and the relevant payment-provider arrangements; any financing adjustments are governed by that provider's agreement. We do not store full payment-card details ourselves.

5. Onboarding and delivery

After acceptance and payment, you will receive onboarding instructions and complete the mandatory Kahunas questionnaire, including health screening and relevant progress photographs or videos. We will prepare an initial personalised Transformation Blueprint, arrange an initial consultation (normally up to 60 minutes), refine your plan and provide the relevant training, nutrition and habit guidance and walkthrough. You are expected to submit your weekly check-in on Sunday morning, including requested measurements and progress images where appropriate. We aim to provide a personalised review by Monday morning UK time where your complete check-in is submitted on time; technical failures, holidays, illness or exceptional circumstances may occasionally cause delays, which we will communicate. Appearance and presence progress is ordinarily reviewed every 28 days. Coaching support through Kahunas is generally provided Monday to Saturday, with a target response within 24 hours during those days; Sundays are normally a rest day. These are service standards rather than guarantees of instant replies or continuous availability.

6. Client responsibilities

You agree to complete onboarding and health questions honestly, update us promptly about relevant changes, use appropriate exercise technique and equipment, exercise within your capabilities, and follow applicable facility rules. You are responsible for deciding whether to undertake an activity and must stop if you experience pain, dizziness, chest discomfort, unusual breathlessness or other concerning symptoms, seeking medical care where appropriate. You will not share your login, coaching materials or personalised programme with other people. You agree to communicate respectfully and engage with check-ins and agreed coaching activities. We may modify or withhold recommendations where we reasonably identify safety concerns.

7. Health screening, risks and medical clearance

Physical exercise, changes in nutrition and lifestyle practices involve inherent risks, including strains, injury, aggravation of existing conditions and adverse health effects. Coaching is not medical care, and no screening process can eliminate all risk. Before receiving a programme you must complete our health-screening questions and related acknowledgements accurately and provide relevant updates throughout the term. A disclosed condition or symptom may require clarification, programme modification or medical clearance before we can safely proceed. We may defer coaching pending that information. You should obtain appropriate medical advice before starting or continuing exercise where recommended or where you have relevant symptoms or conditions. In an emergency, contact local emergency services; coaching messaging is not monitored as an emergency service. Nothing in this section excludes any duty of reasonable care or rights that cannot lawfully be excluded.

8. Results and professional boundaries

Outcomes depend on many factors, including consistency, individual circumstances, health, nutrition, training and recovery. We do not guarantee any particular body composition, appearance, performance, confidence, dating, career or lifestyle outcome. We do not recommend that clients use prescription medicines, hormones, peptides or other substances without appropriately qualified medical oversight. You should not treat educational discussions as a prescription or clinical recommendation.

9. Cancellation, cooling-off rights and refunds

You may request cancellation by emailing jensen@joinprojectkaizen.com. Before the agreed coaching start date, we will consider cancellation requests and apply any mandatory consumer cancellation or cooling-off rights applicable to the transaction, including rights that may apply because of your country of residence. Where applicable law grants a right to cancel within a statutory period, that right prevails over any conflicting wording here. If you expressly request that services start during an applicable cancellation period, any permitted charge for services already provided, or any loss of cancellation rights after full performance, will apply only where the law allows and any legally required disclosures and affirmative consents have been obtained. Once coaching has begun, we do not offer discretionary refunds for a change of mind, lack of engagement, dissatisfaction with results or unused time. This does not limit statutory remedies or refunds where we fail to supply services as legally required. If we cannot deliver a material part of the purchased service, we will seek a fair remedy, which may include replacement delivery, an agreed extension or a proportionate refund, subject to applicable law. A third-party finance provider may impose separate credit cancellation obligations.

10. Pauses and missed participation

Coaching runs continuously over the agreed term. Pauses are not available for ordinary travel, workload or missed check-ins. We may approve a temporary pause in exceptional circumstances, such as significant illness or injury, on a case-by-case basis and may request reasonable supporting information without collecting unnecessary medical details. Any approved pause, duration and revised end date must be confirmed in writing. A pause is not guaranteed and does not automatically entitle you to a refund. Where the law requires a different outcome, mandatory rights apply.

11. Changes, suspension and termination

We may make reasonable adjustments to methods, exercises or delivery platforms while maintaining the essential coaching service. We may temporarily suspend delivery where necessary for safety, security, abusive conduct, serious misuse of services or incomplete health clearance, after reasonable notice where practicable. Either party may terminate for a material breach not remedied within a reasonable period after written notice, unless immediate termination is reasonably necessary for safety or unlawful conduct. If we terminate without client fault or become unable to deliver the remaining material services, we will provide any refund or other remedy required by law and, where appropriate, a fair proportionate refund for undelivered services. If you terminate early for convenience after coaching starts, the no-discretionary-refund rule in section 9 applies, subject always to mandatory rights.

12. Privacy, health data and progress media

We collect and process onboarding answers, relevant health information, training and nutrition records, communications, progress measurements, photographs and videos to assess suitability and deliver coaching, as described in our Privacy Policy. Some information may be sensitive and subject to additional legal safeguards; where a separate explicit consent or other lawful basis is required, we will obtain or establish it before the relevant processing. Service providers such as Kahunas and payment processors may process information for their respective roles. We will not publicly post identifiable progress photographs, videos, testimonials or transformations without separate, specific, optional permission. Declining marketing permission will not affect access to coaching. You may contact us about privacy rights using the address above. The Privacy Policy explains further details and applies alongside these Terms.

13. Intellectual property and client materials

Our programme templates, coaching videos, written materials, branding, methods and other content remain owned by Project Kaizen or its licensors. We grant you a personal, non-exclusive, non-transferable licence to use your coaching materials for your own private purposes during your programme and to retain personal copies afterward where supplied for download. You may not resell, publish, distribute or commercially exploit them without written permission. You retain rights in your own photographs, videos and other materials and grant us only the limited permissions reasonably needed to provide your coaching and operate the service, subject to our Privacy Policy.

14. Availability, technology and communications

You need compatible internet access and a device capable of using our coaching platforms. We are not responsible for failures of third-party connectivity or services outside our reasonable control, but will take reasonable steps to restore or offer an appropriate alternative where our service is materially affected. We may send essential service communications to your supplied email, WhatsApp or Kahunas account. You should not send urgent medical or emergency requests through coaching channels.

15. Liability and mandatory rights

We will perform services with reasonable care and skill. Nothing in these Terms excludes or restricts liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability or consumer remedy that cannot lawfully be excluded or limited. To the extent permitted by applicable law, we are not responsible for losses arising solely from your failure to disclose relevant health information, disregard of safety guidance, misuse of equipment or independent decisions outside the scope of our coaching, except to the extent caused or contributed to by our own breach or negligence. These Terms do not impose a general monetary cap on liability.

16. Complaints and disputes

Please first contact jensen@joinprojectkaizen.com with your order details and concern. We will acknowledge and seek to resolve complaints fairly within a reasonable time. Subject to any mandatory rights and protections available to you as a consumer in your place of residence, these Terms are governed by applicable laws of the United Arab Emirates and disputes are submitted to the competent courts of Dubai, United Arab Emirates. This choice does not deprive you of consumer protections or access to courts that cannot lawfully be waived.

17. General terms and acceptance

If any clause is found unenforceable, the remaining provisions continue to apply where legally possible. A failure to enforce a provision immediately is not a waiver. We may update these Terms for future purchases; material changes affecting an existing paid package require appropriate notice and, where legally required, your agreement. The version accepted at checkout governs your purchase unless validly amended. By ticking the separate, unchecked acceptance box at checkout and completing purchase, you confirm you have had the opportunity to read and agree to these Terms and acknowledge the linked Privacy Policy. We must retain evidence of the accepted version, timestamp and transaction. If checkout cannot capture that evidence, acceptance must be implemented through another verifiable process before paid onboarding.
